Who permits a metal building in Guadalupe County, TX?

The Guadalupe County Fire Marshal Office, 830-303-8856, in the unincorporated county. The order adopts the 2024 International Fire Code with Appendices A through N, effective February 1, 2026, and defines a multi-family dwelling as four or more units and substantial improvement as work costing more than 50 percent of the building value or touching 30 percent or more of the original square footage (county order, read 2026-09-13).

Those three types are the whole reach of the order. Texas gives a county no general commercial building code, and a fire code is the one county power that reaches a commercial building, open only to a county over 250,000 in population or next to one. Does the fire code exempt an agricultural building in Guadalupe County?

It exempts the ones it names, and the wording is narrow. The order does not apply to an agricultural building used specifically to produce or process food products, shelter livestock, or shelter tools and equipment essential to a farm or ranch operation, and it does not apply to an industrial facility with a fire brigade conforming to Occupational Safety and Health Administration requirements (county order, read 2026-09-13). Use is what the clause turns on, not acreage.

It also stops at the fire code. The septic, floodplain and driveway permits run through other offices and none of them reads that clause, and a clear span over 24 feet puts the roof supporting members under the state engineering chapter either way.

What does the permit cost, and how long does it take?

Thirty calendar days is the outside limit and the clock has teeth: no decision within 30 days of a complete application and the fees, and the project is approved for the purposes of the order. Four drawings go with it, filed at the Development Center, 310 IH-10 West in Seguin: a floor plan showing exits, an elevation plan, an electrical plan showing the panel, and a site plan showing every structure and the nearest fire hydrant. At $50,000 of estimated construction cost the state step comes first, because a permitting official may not accept the application without verifying TDLR registration: the TDLR registration guide.

The county values a project at $75.00 per square foot where construction cost is in question, a project valued under $6,250.00 pays a flat $200.00 plus a technology fee, and a separate building permit is required for each structure. From the fee schedule effective February 1, 2026 (Guadalupe County Appendix A fee schedule, read 2026-09-13):

  • Plans review, a $100.00 minimum.

  • The building permit and inspection, covering a minimum of three construction site visits.

  • Final inspection with certificate of compliance, $125.00.

  • Site preparation and foundation, a $500.00 permit of its own.

  • A permit renewal for a further 180 days, $200.00, where work has not started in the first 180.

What does the ground do to a slab in Guadalupe County?

Close to half of it is deep clay. Houston Black-Heiden on uplands is about 22 percent of the county with shrink-swell rated very high, and Branyon-Barbarosa-Lewisville, deep clayey soils on broad ancient stream terraces, is another 23 percent (USDA Soil Survey of Guadalupe County, Texas, 1977, read 2026-09-13).

The rest is not clay. Crockett-Demona-Windthorst is the largest association at about 33 percent, loamy to sandy upland known locally as mesquite land, and about 13 percent is Patilo-Arenosa, the deep sands called the sandhills. Rock shows up in the west, where the Austin Chalk is exposed on the upthrown sides of faults in contact with the Taylor Marl (Texas Water Development Board Report 19, read 2026-09-13). Two tracts a few miles apart can need two different foundations: the slab and foundation guide.

Where does the water go, and is this the Edwards Aquifer?

Not on the TCEQ program county list. The Edwards and associated limestones sit under Guadalupe County only in the subsurface (Texas Water Development Board Report 19, read 2026-09-13). In the San Antonio region the TCEQ Edwards Aquifer program names Bexar, Medina, Comal, Uvalde and Kinney, and Guadalupe is not among them (Texas Commission on Environmental Quality, Edwards Aquifer Protection Program, read 2026-09-13). Balcones faults cut the northwest, Luling-Mexia faults the east and south.

A floodplain development permit from the Environmental Health floodplain manager, 830-303-8858, comes before new construction, an addition or any activity inside the regulated floodplain, and the county counts grading, filling, paving, excavation and drilling as development. It is $300 and construction has to start within 180 days. One acre of disturbance adds TCEQ construction general permit coverage, and five acres makes it large construction with a $225 electronic Notice of Intent.

Septic, power and the way in off the road

Septic has no acreage escape here. The county requires an on-site sewage facility permit regardless of the size of the lot or the acreage, and a License to Operate is held before a system is built, altered, extended or operated. Environmental Health charges $600 for a commercial, multi-unit or rental community system, and building without the permit is fined double the permit fee. The county authorized agent covers everywhere except the City of Marion, while Seguin, New Braunfels and San Marcos hold their own jurisdiction.

Power starts early: Guadalupe Valley Electric Cooperative asks three to five weeks from request to connection and charges builders a $6,000 engineering deposit applied toward the final invoice (the septic, water and electric guide has the order of those calls). Road and Bridge, 830-379-9721, charges $100 for a private or temporary driveway simple crossing and $500 for a commercial driveway, doubled where work starts first, and a new access onto a state highway is TxDOT Form 1058 at the San Antonio District, 210-615-1110.

The county uses $75.00 per square foot to calculate the project valuation where construction cost is in question, and a project valued under $6,250.00 pays a flat $200.00 plus a technology fee. Guadalupe County requires an on-site sewage facility permit for every such facility regardless of the size of the lot or the acreage. Before an on-site sewage facility is built, altered, extended or operated, a person must hold a License to Operate from the Guadalupe County Environmental Health Department or from the Texas Commission on Environmental Quality.
